Prosecutors tried Cruz for the murder three times. The second and third prosecution were <em>after</em> a proven multiple-child-killer named Brian Dugan offered to confess to the Nicarico killing in exchange for avoiding the death penalty. Prosecutors simply changed their theory of the case, insisting that Cruz must have been helping Dugan.
